If you delete your account, we will delete your personal data within 30 days, except where we are required by law to retain certain information. Aggregated, anonymised analytics data may be retained indefinitely as it cannot be used to identify you.

5. Subscriptions, Payments & Refunds

Free Tier: The Home Harvester offers a free tier with limited features. No payment information is required to use the free tier.

Pro Subscription: Our Pro plan is offered on a monthly subscription basis. Pricing is displayed in your local currency, auto-converted from AUD at live exchange rates, and is clearly shown before you commit to any purchase.

7-Day Free Trial: New subscribers receive a 7-day free trial. You will not be charged during the trial period. If you cancel before the end of the trial, you will not be charged. After the trial period, your subscription will automatically renew at the applicable monthly rate.

Billing: Subscriptions are billed monthly in advance. Your subscription renews automatically each month until cancelled. You can cancel at any time through your account settings.

Cancellation: Cancelling your subscription takes effect at the end of the current billing period. You will retain access to Pro features until the end of the period you have paid for. We do not offer pro-rata refunds for partial periods.

Refunds: If you experience a technical problem that prevents you from using the service during a paid period, please contact us at support@thehomeharvester.com within 14 days. We assess refund requests on a case-by-case basis and will act fairly.

Price Changes: We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price changes to existing subscribers via email.

Payment Security: All payments are processed by Stripe. We never store your card details on our servers. All transactions are encrypted using SSL/TLS.

6. User-Generated Content

Our platform allows you to create and share content including forum posts, community updates, photos, garden journal entries, harvest logs, and marketplace listings ("User Content"). By submitting User Content, you:

•Retain full ownership of your User Content
•Grant The Home Harvester a non-exclusive, royalty-free licence to display, distribute, and promote your content within the platform
•Confirm that your content does not infringe the intellectual property rights of any third party
•Accept responsibility for ensuring your content complies with these Terms and applicable laws
•Agree that we may remove content that violates our Community Guidelines without notice

You must not post content that is unlawful, defamatory, harassing, threatening, obscene, fraudulent, or that infringes on the rights of others. We reserve the right to remove any content and terminate accounts that violate these standards.

7. Community Guidelines

The Home Harvester is built on the values of a welcoming, supportive gardening community. All users are expected to:

Violations of our Community Guidelines may result in content removal, temporary suspension, or permanent account termination, at our sole discretion.

8. Intellectual Property

All content on The Home Harvester that is not User Content — including but not limited to the platform design, plant growing guides, seasonal calendars, pest guides, recipes, code, graphics, logos, trademarks, and brand identity — is the exclusive intellectual property of The Home Harvester and is protected by Australian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of our proprietary content without our prior written consent. Personal, non-commercial use of our platform is permitted within the scope of these Terms.

9. Marketplace & Exchanges

The Home Harvester provides marketplace, harvest exchange, seed swap, and plant swap features that allow users to transact with each other. Important terms apply:

•The Home Harvester acts as a platform facilitator only — we are not a party to transactions between users
•Users are responsible for the accuracy of their listings and the quality and safety of items exchanged
•All transactions are conducted at your own risk and we encourage exercising reasonable caution
•We are not responsible for disputes arising from transactions between users
•Users must comply with all applicable laws regarding the sale of food, plants, and agricultural products
•Listing or exchanging invasive species, prohibited plants, or items that violate biosecurity laws is strictly prohibited
•Sellers are responsible for accurate descriptions, fair pricing, and fulfilment of orders

10. Disclaimers & Limitation of Liability

Gardening Advice Disclaimer: All growing guides, planting calendars, pest diagnoses, AI advisor responses, and other agricultural content provided by The Home Harvester are for general informational and educational purposes only. While we strive for accuracy, growing outcomes depend on many factors beyond our control including local conditions, weather, soil, pests, and individual gardening practices. We do not warrant that following our advice will result in any particular gardening outcome. Always use your own judgement and consult local experts for critical decisions.

AI Advisor: Our AI-powered garden advisor uses advanced language models to generate responses. These responses are educational guidance only and should not be treated as professional horticultural, agricultural, or health advice. Always verify AI-generated advice independently before applying it to valuable plants or crops.

Service Availability: We aim to provide a reliable service but do not warrant uninterrupted, error-free access. The platform is provided "as is" without warranties of any kind, express or implied.

Limitation of Liability: To the maximum extent permitted by law, The Home Harvester shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our service. Our total liability for any claim arising from your use of the service shall not exceed the amount you have paid us in the 12 months preceding the claim.

11. Account Termination

By you: You may delete your account at any time through your account settings or by contacting us at support@thehomeharvester.com. Upon deletion, your personal data will be removed within 30 days as described in Section 4.6.

By us: We reserve the right to suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or use the platform in a way that harms other users or the service. We will endeavour to give reasonable notice where practicable. Termination does not affect any accrued rights or liabilities. Sections 4, 8, 10, and 14 survive termination.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Australian Capital Territory, Australia, without regard to conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in Canberra, ACT, Australia for resolution of any disputes.

Before initiating any legal proceedings, we both agree to attempt to resolve any dispute informally by contacting the other party. If we cannot resolve the dispute informally within 30 days, either party may proceed with formal dispute resolution. For minor disputes under AUD $5,000, we encourage resolution through the Australian Competition and Consumer Commission (ACCC) or relevant state consumer protection agency.
